Addendum to End-User License Agreement

ADDENDUM TO END-USER LICENCE AGREEMENT PAY WHAT YOU WANT LICENCE

This Addendum modifies and supplements the End-User Licence Agreement (“EULA”) dated 2024-10-18 for specific font products offered under Atropical AS’s Pay What You Want programme.

1. APPLICABILITY

This Addendum applies exclusively to fonts distributed under the Pay What You Want model, where purchasers may choose their payment amount, including 0 NOK (zero Norwegian kroner).

2. Modified Grant of Licence

For fonts acquired under the Pay What You Want programme, Section 2 of the original EULA is modified as follows:

Combined Licence Grant

Each licence acquired includes:

• Desktop Licence: Installation and use on up to five (5) computing devices (desktop computers, laptops, and workstations) per licence
• Web Fonts Licence: Embedding on websites according to the following viewer limits per licence:
  • 1 licence: up to 100,000 viewers per month
  • 2 licences: up to 250,000 viewers per month
  • 3 licences: up to 500,000 viewers per month
  • 4 licences: up to 1,000,000 viewers per month
  • For viewer counts exceeding 1,000,000 per month, additional licences are required
• App Licence: Embedding in one (1) application per platform per licence, without user limits

Acquiring Multiple Licences

If your usage requirements exceed the limits of a single licence, you may acquire multiple licences by completing additional purchases through the Pay What You Want programme. Each purchase grants one additional licence. You determine the payment amount for each licence, including 0 NOK.

3. Restrictions Remain in Full Force

All restrictions outlined in Section 3 of the original EULA remain fully applicable, including but not limited to:

• Prohibition on modification, reverse engineering, or disassembly
• Prohibition on distribution, resale, or sub-licensing to third parties
• Prohibition on sharing with external designers or service providers
• Prohibition on unauthorised font serving technologies

Important: The Pay What You Want pricing model does not grant you rights to redistribute, share, or resell the fonts. Each end user must obtain their own licence directly from Atropical AS.

4. Voluntary Payment Model

4.1 No Refunds

As this is a voluntary payment model where the purchaser determines the price (including 0 NOK), all payments are final and non-refundable.

4.2 Good Faith Usage

By downloading fonts under this programme, you acknowledge that:

• This is offered as a gesture of goodwill and accessibility
• You are encouraged to pay what you believe is fair based on your usage and means
• Commercial entities and professional users are particularly encouraged to pay amounts that reflect commercial value

4.3 Support and Updates

Access to technical support and font updates may be prioritised based on payment tier, at the sole discretion of Atropical AS.

5. All Other Terms Unchanged

All other terms and conditions of the original EULA dated 2024-10-18 remain in full force and effect, including:

• Section 4: Embedding provisions
• Section 5: Ownership and intellectual property rights
• Section 6: Termination rights
• Section 7: Disclaimer of warranties
• Section 8: Limitation of liability
• Section 9: Governing law (Norway)
• Section 10: Contact information

6. Precedence

In the event of any conflict between this Addendum and the original EULA, this Addendum shall take precedence solely with respect to fonts acquired under the Pay What You Want programme.
