End-User License Agreement

1. Introduction

This End-User Licence Agreement (“EULA”) is a legal agreement between you and Atropical AS (“we”, “our”, or “us”) for the use of our font software (“Fonts”). By downloading, installing, or using our Fonts, you agree to be bound by the terms of this EULA.

2. Grant of Licence

We offer three types of licences for our Fonts:

Desktop Licence

A Desktop Licence allows you to install and use the Fonts on a specified number of computing devices, including but not limited to desktop computers, laptops, and workstations. The number of devices must be agreed upon at the time of purchase.

Web Fonts Licence

A Web Fonts Licence allows you to embed the Fonts on websites with the following viewer limits:

• 1 licence: up to 100,000 viewers per month
• 2 licences: up to 250,000 viewers per month
• 3 licences: up to 500,000 viewers per month
• 4 licences: up to 1,000,000 viewers per month

For viewer counts exceeding 1,000,000 per month, additional licences must be purchased accordingly.

App Licence

An App Licence allows you to embed the Fonts in one application per platform without user limits. For the purposes of this licence, “one application” is defined as a single software program or mobile app that is distributed on a single platform (e.g., iOS, Android, Windows, macOS). Any additional applications or platforms will require separate licences.

Further Licencing

Any other use cases must be separately agreed upon and explicitly approved in writing by Atropical AS.

3. Restrictions

You may not:

• Modify, adapt, translate, reverse engineer, decompile, or disassemble the Fonts.
• Change or replicate the Font Software or any of its design elements, in full or partially, without obtaining prior written permission from the Licensor.
• Distribute, sell, lease, sub-license, duplicate, loan, or resell the Fonts to any third party. This includes sharing the Fonts via e-mail, USB sticks, CD-ROMs, or other media, uploading them to public or private servers, or making them available on peer-to-peer networks. Passing the Fonts to external designers or service providers (such as design agencies, repro studios, printers, etc.) is also prohibited.
• Use the Fonts in any manner that violates applicable laws or regulations.
• Without the prior written consent of the Licensor, you are forbidden from transmitting the Font Software over the Internet for purposes such as font serving or font replacement using technologies including, but not limited to, EOT, Cufon, sIFR, or any future similar technologies.

4. Embedding

You are allowed to embed the Font Software in PDFs and other digital documents as long as it is done in a secure, read-only format. It is imperative that the recipient cannot use the Font Software to modify or create new documents. The design files (PDFs or similar) generated in this manner can be distributed without limitation.

Embedding the Font Software in web pages or applications requires their own specific licences. Extracting the Font Software, either in full or in part, is strictly forbidden.

5. Ownership

The Fonts are the intellectual property of Atropical AS and are protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any ownership rights to the Fonts.

6. Termination

This EULA is effective until terminated. We may terminate this EULA at any time if you breach any of its terms. Upon termination, you must cease all use of the Fonts and destroy all copies in your possession.

7. Disclaimer of Warranties

The Fonts are provided “as is” without any warranties, express or implied. We do not warrant that the Fonts will meet your requirements or that their operation will be uninterrupted or error-free.

8. Limitation of Liability

In no event shall Atropical AS be liable for any damages arising out of the use or inability to use the Fonts, even if we have been advised of the possibility of such damages.

9. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
